At Telos, we take your privacy seriously. Please read this Privacy Policy to learn how we handle the personal information we collect in connection with our app and our related services. By using or accessing our Services in any manner, you acknowledge that you accept the practices and policies outlined below, and you hereby consent that we will collect, use and share your information as described in this Privacy Policy. Our Privacy Principles

We wrote this Privacy Policy to help you understand what personal information we collect, how we use and disclose it, and what choices you have about it.

  • We will delete your data if you ask us to. We store the data we query from the content you upload to our servers, but we will delete this information upon your request.
  • We do not train our algorithms with the content you provide, or share your content with other Telos users. We only use the data you upload to provide our services back to you.
  • We do not advertise or market to you using the content you upload. We monetize our services by offering subscriptions to our users, not by selling your information.
  • You control how much of your information you share with us. Before syncing with any data such as your calendar, we ask for your permission to grant us access.

Personal Information We Collect

Information you provide through the app

  • Contact details, including your first and last name and email address.
  • Account information, such as your account credentials and other information used to administer your account, include the services you have purchased or may be interested in.
  • Content you upload, such the images, videos, audio clips, text, and files you choose to upload. 
  • Geolocation information, that you provide for us to share real-time recommendations based on your location with you.
  • Payment information needed to complete your purchase of an app subscription (including name, payment card information, billing information). Payment information is processed by Stripe, our third-party payment processor, and we do not store payment card numbers.
  • Usage information, such as data about how you use the app and interact with us, including metadata associated with any content you upload to the app or otherwise submit to us.
  • Communications that we exchange with you, including when you contact us with questions, feedback, or otherwise.
  • Marketing information, such as your preferences for receiving communications about our services and publications, and details about how you engage with our communications.
  • Other information that we may collect which is not specifically listed here, but which we will use in accordance with this Privacy Policy or as otherwise disclosed at the time of collection.

Third party sources. We may combine personal information we receive from you with personal information we obtain from other sources, such as:

  • Social media platforms. If you access our services through a social networking site or a third-party login service, we may collect information about you from that third party that you have made available via your privacy settings.

Automatic data collection

We and our service providers may automatically log information about you, your computer or mobile device, and your interaction over time with our services, such as your computer’s or mobile device’s operating system, manufacturer and model, browser type, IP address, unique identifiers, language settings, mobile device carrier, and general location information such as city, state or geographic area. Our Use of Cookies

What are cookies and similar technologies?

  • Cookies are text files that websites store on a visitor’s device to uniquely identify the visitor’s browser or to store information or settings in the browser for the purpose of helping you navigate between pages efficiently, remembering your preferences, enabling functionality, and helping us understand activity and patterns.
  • Local storage technologies, like HTML5, provide cookie-equivalent functionality but can store larger amounts of data, including on your device outside of your browser in connection with specific applications.
  • Web beacons, also known as pixel tags or clear GIFs, are used to demonstrate that a webpage or email was accessed or opened, or that certain content was viewed or clicked.

All of these technologies, and other types of tracking technologies used through our services, are collectively referred to as “cookies.”

How do we use cookies and other similar technologies?

We use both persistent cookies and session cookies. Persistent cookies stay on your device for a set period of time or until you delete them, while session cookies are deleted once you close your web browser. We use persistent cookies, for example, to record your choice of language and country location. The cookies placed through your use of our website are either set by us (first-party cookies) or by a third party at our request (third-party cookies).

What types of cookies and similar technologies does Telos use?

Essential. We use essential cookies to help make our website usable by enabling basic functions like page navigation and access to secure areas of the website. You can set your browser to block or alert you about these cookies, but then some parts of the websites will not work.

Functionality / performance. We use these cookies to enhance the functionality and performance of the services.

We may also use web beacons in promotional emails and other communications with you, to allow us to count how many people read them and to verify any clicks through to links within an email. We (or our marketing service providers on our behalf) use this to help us understand how an email campaign performed, what types of emails and content our recipients find interesting, and what actions our recipients took, so we can improve our email campaigns in the future and make our emails more relevant to our recipients. If you do not wish the web beacon to be downloaded onto your device, you should select to receive emails from us in plain text rather than HTML.

You can also limit online tracking by:

  • Blocking cookies in your browser. Most browsers let you remove or reject cookies. To do this, follow the instructions in your browser settings. Many browsers accept cookies by default until you change your settings.   • Using privacy plug-ins or browsers. You can block our websites from setting cookies by using a browser with privacy features or installing browser plugins and configuring them to block third party cookies/trackers.

Note that because these opt out mechanisms are specific to the device or browser on which they are exercised, you will need to opt out on every browser and device that you use.

How We Use Personal Information

We use personal information for the following purposes:

To provide our services. We use personal information to operate, maintain, and provide you with our services. Except where consent is required, we use personal information to perform our contractual obligations under our terms of service. Where we seek your consent, you may withdraw your consent at any time.

To communicate about our services. It is in our legitimate business interests to use personal information to respond to your requests, provide customer support, and communicate with you about our services, including by sending announcements, updates, security alerts and support and administrative messages.

To improve, monitor, personalize, and protect our services. It is in our legitimate business interests to improve and keep our services safe for our users, which includes:

  • understanding your needs and interests, and personalizing your experience with the services and our communications;
  • troubleshooting, testing and research and to keep the services secure; and
  • investigating and protecting against fraudulent, harmful, unauthorized or illegal activity.

For research and development. We may use personal information for research and development purposes in our legitimate business interests, including to analyze and improve the services and our business. As part of these activities, we may create or use aggregated, de-identified or other anonymized data from personal information we collect. We make personal information into anonymized data by removing information that makes the data personally identifiable to you. We may use this anonymized data and share it with third parties for our lawful business purposes, including to analyze and improve the services and promote our business.

For direct marketing. We may send you direct marketing communications as permitted by law, including by email. You may opt-out of our marketing communications as described in the Opt out of direct marketing communications section below. Except where consent is required, we undertake such marketing on the basis of our legitimate business interests. Where we seek your consent, you may withdraw your consent at any time.

For compliance and protection. We may use personal information to comply with legal obligations, and to defend us against legal claims or disputes, including to:

  • protect our, your or others’ rights, privacy, safety or property (including by making and defending legal claims);
  • audit our internal processes for compliance with legal and contractual requirements and internal policies;
  • enforce the terms and conditions that govern the services;
  • prevent, identify, investigate and deter fraudulent, harmful, unauthorized, unethical or illegal activity, including cyberattacks and identity theft; and
  • comply with applicable laws, lawful requests and legal process, such as to respond to subpoenas or requests from government authorities.

How We Disclose Personal Information

We do not sell personal information. We may disclose personal information to:

Service providers, that provide services on our behalf or help us operate our services or our business (such as hosting, communications, data and cyber security, billing and payment processing, fraud and bias detection, investigation and prevention, web and mobile analytics, and email and communication distribution and monitoring).

Third-party AI providers, such as OpenAI, that we use to help support our AI-powered assistant. We require these providers to use your information only for the purpose of facilitating our AI-powered tool, and we do not allow these providers to train their AI models using your personal information.

Professional advisors, such as lawyers, auditors, bankers and insurers, where necessary in the course of the professional services that they render to us.

Law enforcement, government authorities, and private parties, as we believe in good faith to be necessary or appropriate, for the compliance and protection purposes described above.

Acquirers and other relevant participants in business transactions (or negotiations for such transactions) involving a corporate divestiture, merger, consolidation, acquisition, reorganization, sale or other disposition of all or any portion of the business or assets of, or equity interests in, Telos Labs, Inc. or our affiliates (including, in connection with a bankruptcy or similar proceedings).

Privacy Rights and Choices

Opt out of direct marketing communications. You may opt out of marketing-related communications by following the opt-out or unsubscribe instructions contained in the marketing communication we send you. You may continue to receive service-related and other non-marketing communications.

Opt out of location tracking. You may allow or disallow Telos to collect geolocation data by enabling or disabling location services on your device.

Opt out of online tracking. You can opt out of third-party cookies as described in our Cookie Policy.

Opt out of push notifications. If you opt in to receive push notifications within the app, we may send push notifications or alerts to your mobile device from time to time. You can deactivate push notifications and alerts at any time by changing your device settings, changing the push notification settings within the application, or deleting the app.

Privacy rights requests. We also offer you choices that affect how we handle the personal information that we control. Depending on your location and the nature of your interactions with our services, you may request the following in relation to personal information:

  • Information about how we have collected and used personal information. We have made this information available to you without having to request it by including it in this Privacy Policy.
  • Access to a copy of the personal information that we have collected about you. Where applicable, we will provide the information in a portable, machine-readable, readily usable format.
  • Correction of personal information that is inaccurate or out of date.
  • Deletion of personal information that we no longer need to provide the services or for other lawful purposes.
  • Additional rights, such as to object to and request that we restrict our use of personal information.
  • Appeal our denial of your privacy request by contacting us as set out below.

To make a request, please email us or write to us as provided in the How to Contact Us section below. We may ask for specific information from you to help us confirm your identity. Depending on where you reside, you may be entitled to empower an “authorized agent” to submit requests on your behalf. We will require authorized agents to confirm their identity and authority, in accordance with applicable laws. You are entitled to exercise the rights described above free from discrimination.

Limits on your privacy rights and choices. In some instances, your choices may be limited, such as where fulfilling your request would impair the rights of others, our ability to provide a service you have requested, or our ability to comply with our legal obligations and enforce our legal rights. If you are not satisfied with how we address your request, you may submit a complaint by contacting us as provided in the How to Contact Us section below. Depending on where you reside, such as if you reside in the European Economic Area or United Kingdom, you may have the right to complain to a data protection regulator where you live or work, or where you feel a violation has occurred.

International Data Transfers

You provide personal information directly to us in the United States. We may also transfer personal information to our affiliates and service providers in the United States and other jurisdictions. Please note that such jurisdictions may not provide the same protections as the data protection laws in your home country.

When we engage in cross-border data transfers, we will ensure that relevant safeguards are in place to afford adequate protection for personal information and we will comply with applicable data protection laws, in particular by relying on an EU Commission or UK government adequacy decision or on contractual protections for the transfer of personal information. Retention of Personal Information

Where required under applicable laws, we retain personal information only for as long as is necessary to fulfill the purposes for which it was collected and processed, in accordance with our retention policies, and in accordance with applicable laws and regulatory obligations or until you withdraw your consent (where applicable).

To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of personal information, the purposes for which we use personal information and whether we can achieve those purposes through other means, and the applicable legal and regulatory requirements.

Other Sites and Services

Our services may contain links to websites and other online services operated by third parties. In addition, our content may be integrated into web pages or other online services that are not associated with us. These links and integrations are not an endorsement of, or representation that we are affiliated with, any third party. We do not control websites or online services operated by third parties, and we are not responsible for their actions. This Privacy Policy does not apply to such third-party sites or services.

Data Security

We employ a number of technical, organizational and physical safeguards designed to protect the personal information we collect. However, no security measures are failsafe and we cannot guarantee the security of your personal information.

Children

Our services are not intended for use by children under 13 years of age. If we learn that we have collected personal information through our services from a child under 13 without the consent of the child’s parent or guardian as required by law, we will delete it. If you are a parent or guardian of a user of our Services who is under 13 years of age, you may contact us at any time to ask that (a) we stop collecting Personal Data from such user, (b) we delete any Personal Data already collected from such user (although note that we may further retain information in an anonymous or aggregated form where that information would not identify such user personally), or (c) we stop disclosing Personal Data collected from such user to third parties, but continue to allow for collection and use of Personal Data collected from such user in connection with the Services.

Changes to This Privacy Policy

We reserve the right to modify this Privacy Policy at any time. Upon such changes, we will alert you to any such changes by placing a notice on the Telos website, by sending you an email and/or by some other means. If you use the Services after any changes to the Privacy Policy have been posted, that means you agree to all of the changes.
